Managing Medical Bills While Your Claim Is Pending
Bills do not wait for a settlement. Here is how to keep them from going to collections while your case is being resolved.
One of the hardest parts of accident recovery is the gap between when medical bills arrive and when a settlement (if any) is paid. Months or even years can pass. The good news: you have options.
Use your own coverage first Health insurance, PIP, and MedPay can all pay bills now. Using them does not waive your right to recover from the at-fault driver later, but the insurer that paid may be entitled to reimbursement from a future settlement (this is called subrogation).
Ask providers to wait Many hospitals and clinics will hold a bill in pending status if they know an accident claim is in progress. Call the billing department, explain the situation, and request a hold.
Liens and letters of protection Some providers will treat you on a lien or under a letter of protection. They agree to wait for payment until your case resolves, in exchange for a promise to be paid from the proceeds. This is common for chiropractic, physical therapy, imaging, and pain management.
Negotiate balances Medical bills are often negotiable, especially after a settlement is reached. Providers regularly accept reduced amounts when paid in a lump sum.
What to avoid Do not ignore bills. Even when an accident claim is pending, providers can send accounts to collections, which damages your credit. Keep communicating, document every call, and ask for written confirmation of any holds.
